                    },

                        "data": "the new Ontario rules. "

                        "data": "(CCDC) has introduced a new standard form contract for "
                    },
                    {
                        "data": "Integrated Project Delivery (IPD) – reflecting the current "
                    },
                    {
                        "data": "trend towards projects where design and construction "
                    },
                    {
                        "data": "are collaborative, with shared risk and opportunities for "
                    },
                    {
                        "data": "profit if things go right, and penalties and risk-limiting "
                    },
                    {
                        "data": "controls if they go wrong. "
                    },
                    {
                        "data": "CCDC chair Mark Mulholland, vice-president project "
                    },
                    {
                        "data": "delivery services operations at BGIS, and construction "
                    },
                    {
                        "data": "lawyer Geza Banfai from McMillan LP, outlined the con- "
                    },
                    {
                        "data": "cepts behind the new CCDC 30 contract and explained "
                    },
                    {
                        "data": "how it compares to other construction contract models at "
                    },
                    {
                        "data": "a May 4 workshop in Ottawa, one of several held across "
                    },
                    {
                        "data": "the country. "
                    },
                    {
                        "data": "“CCDC 30 reads like nothing you are really used to,” "
                    },
                    {
                        "data": "Mulholland said. “It’s intensely collaborative. If you can’t "
                    },
                    {
                        "data": "play nicely in the sandbox, there are mechanisms to have "
                    },
                    {
                        "data": "you thrown out. The risk pool to my mind is the element "
                    },
                    {
                        "data": "of the contractual arrangements that give it its power.” "
                    },
                    {
                        "data": "Success is very clear because the parties spend a "
                    },
                    {
                        "data": "great degree of time on mutually agreeing upon the price, "
                    },
                    {
                        "data": "scope, schedule, and quality. “When you achieve suc- "
                    },
                    {
                        "data": "cess, you get your risk pool,” he said. If the project goes "
                    },
                    {
                        "data": "above budget, and the final cost burns into the contingen- "
                    },
                    {
                        "data": "cies, pre-identified by mutual agreement, “then you are "
                    },
                    {
                        "data": "into the risk pool and the owner is now spending your "
                    },
                    {
                        "data": "profit.” However, if the project is way off budget, “the owner "
                    },
                    {
                        "data": "continues to pay the costs if they are above the risk pool "
                    },
                    {
                        "data": "and contingencies.” "
                    },
                    {
                        "data": "“Owners like it, because the risk of costs increasing "
                    },
                    {
                        "data": "above the top line is closely and collaboratively man- "
                    },
                    {
                        "data": "aged,” Banfai said. “Contractors like it, because at least "
                    },
                    {
                        "data": "they are going to (recover) their costs. In the worst case "
                    },
                    {
                        "data": "scenario, they aren’t going to get a profit but they are "
                    },
                    {
                        "data": "going to get their costs.” "
                    },
                    {
                        "data": "Of course, the process requires quite a bit of co-ordi- "
                    },
                    {
                        "data": "nation and planning, since the key players including the "
                    },
                    {
                        "data": "owner, design consultants, general contractor, and key "
                    },
                    {
                        "data": "subtrades need to participate as a team from the start, "
                    },
                    {
                        "data": "even as they compete for the contract, which will be for a "
                    },
                    {
                        "data": "building for which there is not yet a design. "
                    },
                    {
                        "data": "“On day one, when CCDC 30 is signed, as of this date, "
                    },
                    {
                        "data": "there is no project yet,” Banfai said. “There may be a bud- "
                    },
                    {
                        "data": "get but it’s just a thumbnail. There’s no scope, there’s no "
                    },
                    {
                        "data": "design, even all of the parties may not be confirmed. At "
                    },
                    {
                        "data": "this point, the project is a gleam in the owner’s eye.” "
                    },
                    {
                        "data": "The first stage, Banfai said, is the “validation phase”. "
                    },
                    {

                        "data": "“This can extend for a number of months, when a "
                    },

                        "data": "whole bunch of things happen. Owners, and design and "
                    },
                    {
                        "data": "construction teams meet intensively to take this gleam in "
                    },
                    {
                        "data": "the owner’s eye and turn it into something that will be "
                    },
                    {
                        "data": "sufficient to allow a go/no go decision.” "
                    },
                    {
                        "data": "During this time, the team coalesces psychologically, "
                    },
                    {
                        "data": "with a project management team, senior management "
                    },
                    {
                        "data": "team and project implementation teams. "
                    },
                    {
                        "data": "“At this stage, the design is worked up to a point, "
                    },
                    {
                        "data": "where a base target cost can be comfortably deter- "
                    },
                    {
                        "data": "mined,” Banfai said. “The site investigations are done, "
                    },
                    {
                        "data": "usual due diligence along the way is done, all under the "
                    },
                    {
                        "data": "management of the project team.” "
                    },
                    {
                        "data": "Participants conduct meetings where the expected "
                    },
                    {
                        "data": "profits are identified and tabled in an open-book way so "
                    },
                    {
                        "data": "as to establish a Risk Pool, and risk allocation percent- "
                    },
                    {
                        "data": "ages are determined. "
                    },
                    {
                        "data": "Then a “validation report” is produced, which “essen- "
                    },
                    {
                        "data": "tially is the business case for the project.” "
                    },
                    {
                        "data": "If the business case cannot be met,the owner has the "
                    },
                    {
                        "data": "option of terminating the contract, paying the design and "
                    },
                    {
                        "data": "construction team for their costs but not their profit. "
                    },
                    {
                        "data": "“The profit of the construction and design team mem- "
                    },
                    {
                        "data": "bers is at risk from day one.” "
                    },
                    {
                        "data": "If the project is a “go”, then the design and procure- "
                    },
                    {
                        "data": "ment phase commences, overlapping slightly with the "
                    },
                    {
                        "data": "construction phase which follows. During design and "
                    },
                    {
                        "data": "procurement, the design is refined taking constructability "
                    },
                    {
                        "data": "and value engineering into account and looking for ways "
                    },
                    {
                        "data": "to “tweak the design so as to bring greater value to the "
                    },
                    {
                        "data": "owner for the dollars committed and/or savings, and at "
                    },
                    {
                        "data": "the conclusion of which you come up with a final target "
                    },
                    {
                        "data": "cost.” “This number is the one that really matters for risk "
                    },
                    {
                        "data": "pool distribution purposes,” Banfai said. “The idea is that "
                    },
                    {
                        "data": "during the design and procurement phase, the parties "
                    },
                    {
                        "data": "seek to find innovations and savings.” "
                    },
                    {
                        "data": "Typically, this work is done collaboratively in a “big "
                    },
                    {
                        "data": "room” -- with desks, computers, blueprint machines, "
                    },
                    {
                        "data": "cork-boards and whiteboards on the walls and sticky "
                    },
                    {
                        "data": "colour coded notes. "
                    },
                    {
                        "data": "The concept is new and the speakers acknowledged "
                    },
                    {
                        "data": "that while it is “taking off slowly in Canada, more and "
                    },
                    {
                        "data": "more (IPD projects) are coming on line.” "
                    },
                    {
                        "data": "“I don’t want to suggest this is for everybody,” Banfai "
                    },
                    {
                        "data": "said. “It starts with an owner who gets it.” "
                    },
                    {
                        "data": "Earlier in the session, lawyer Banfai said he believes "
                    },
                    {
                        "data": "the most important quality for project success or failure "
                    },
                    {
                        "data": "are the individuals running the job. "
                    },
                    {
                        "data": "“It’s amazing how just one person – the wrong person "
                    },
                    {
                        "data": "– can completely screw up a project,” Banfai said. “Multi- "
                    },
                    {
                        "data": "million dollars worth of failure, can happen because of "
                    },
                    {
                        "data": "one sociopath.” "
                    },
                    {
                        "data": "Banfai said it is important to get these troublesome "
                    },
                    {
                        "data": "people out of the job as soon as possible. "
                    },
                    {
                        "data": "“Sometimes it is really hard, especially if the individual "
                    },
                    {
                        "data": "is at the top of the food chain,” he said. “That is a real "
                    },
                    {
                        "data": "problem. The only effective way is that you have to re- "
                    },
                    {
                        "data": "move this person from the project one way or another.” "
                    },
                    {
                        "data": "“If the problem is at the project management level, it "
                    },
                    {
                        "data": "helps if the senior management and the members of the "
                    },
                    {
                        "data": "project team have a strong relationship and strong social "
                    },
                    {
                        "data": "trust, so that they can have these candid conversations "
                    },
                    {
                        "data": "about “Frank” and have the troublemaker removed.” "
                    },
                    {
                        "data": "Fortunately, these issues would become apparent and "
                    },
                    {
                        "data": "be resolved early in true IDP projects, where CCDC-30 "
                    },
                    {

                        "data": "about to experience a radical, transformative and critical "
                    },

                        "data": "The answer, according to some industry leaders, is "
                    },

                        "data": "“yes” -- as the industry’s inefficiencies and intermediary- "
                    },
                    {
                        "data": "loaded framework experiences stress as owners press "
                    },
                    {
                        "data": "for greater efficiencies and disruptive integrated organi- "
                    },
                    {
                        "data": "zations are changing the meanings of modular design- "
                    },
                    {
                        "data": "build to much more comprehensive and wide-scale "
                    },
                    {
                        "data": "applications. Not surprisingly, many of these changes are being led "
                    },
                    {
                        "data": "by U.S.-based organizations, though there are significant "
                    },
                    {
                        "data": "areas including artificial intelligence (machine learning) "
                    },
                    {
                        "data": "where Canadians have a leadership role. "
                    },
                    {
                        "data": "To learn more about where the industry is heading, I "
                    },
                    {
                        "data": "accepted a media invitation to attend the TECH+ Confer- "
                    },
                    {
                        "data": "ence in Manhattan in May, sponsored by the The Archi- "
                    },
                    {
                        "data": "tect’s Newspaper. (In exchange for a secondary media "
                    },
                    {
                        "data": "sponsorship status, we received an attendee pass, but I "
                    },
                    {
                        "data": "paid my own travel and accommodation costs.) "
                    },
                    {
                        "data": "During the day-long event, several speakers outlined "
                    },
                    {
                        "data": "critical issues, including collaboration/BIM, sustainability "
                    },
                    {
                        "data": "and visualization, as a variety of industry technology busi- "
                    },
                    {
                        "data": "nesses demonstrated their products and services. "
                    },
                    {
                        "data": "Several speakers observed that the AEC industry is "
                    },
                    {
                        "data": "near the bottom of the bell curve in technological adapta- "
                    },
                    {
                        "data": "tion, only slightly better than architecture. "
                    },
                    {
                        "data": "Perhaps the biggest “wow” moment occurred for me "
                    },
                    {
                        "data": "when Chris Meyer, Boston-based general contractor and "
                    },
                    {
                        "data": "Suffolk’s chief information officer, displayed a graph "
                    },
                    {
                        "data": "showing the sudden and dramatic market decline for "
                    },
                    {
                        "data": "newspaper advertising in the last decade. We’ve pub- "
                    },
                    {
                        "data": "lished a story in our U.S. publications about Suffolk’s "
                    },
                    {
                        "data": "multi-city Smart Lab concept, but I didn’t connect the "
                    },
                    {
                        "data": "dots until his speech that Meyer had previously been the "
                    },
                    {
                        "data": "Boston Globe’s publisher. "
                    },
                    {
                        "data": "Meyer displayed a graph that showed that, while the "
                    },
                    {
                        "data": "newspaper industry was well aware of the Internet’s rise "
                    },
                    {
                        "data": "and developed different models to cope with the "
                    },
                    {
                        "data": "change, it could not stop the steep and dramatic crash "
                    },
                    {
                        "data": "that started about the turn of the millennium, as Google "
                    },
                    {

                        "data": "In fact, newspaper advertising revenue has declined by "

                        "data": "about four-fifths in the past decade, so advertising rev- "
                    },

                        "data": "enues are now even lower than they were in the 1950s. "
                    },

                        "data": "Newspaper digital sales have made the slightest gain; "
                    },

                        "data": "but the data is clear – the conventional newspaper in- "
                    },
                    {
                        "data": "dustry has been pushed over the cliff, and in just a few "
                    },
                    {
                        "data": "years. Meyer suggested that AEC, like the newspaper busi- "
                    },

                        "data": "ness, is an “intermediary” industry – that is, most practi- "
                    },
                    {
                        "data": "tioners are serving others in the value chain rather than "
                    },
                    {
                        "data": "end users -- and he suggested this could create a situa- "
                    },
                    {
                        "data": "tion where there will be major disruptions as new tech- "
                    },
                    {
                        "data": "nologies capture market presence and share. "
                    },
                    {
                        "data": "Will this happen anytime soon? That is the big ques- "
                    },
                    {
                        "data": "tion. And the AEC industry may be saved (or ultimately "
                    },
                    {
                        "data": "destroyed) by its current structure, where various pro- "
                    },
                    {
                        "data": "fessionals often work in their own silos. "
                    },
                    {
                        "data": "Keynote speaker Dennis Sheldon, director of the Digi- "
                    },
                    {
                        "data": "tal Building Laboratory (DBL) at the Georgia Institute of "
                    },
                    {
                        "data": "Technology, shared some insights into the challenges "
                    },
                    {
                        "data": "(and opportunities) that the technology creates for link- "
                    },
                    {
                        "data": "ages and collaboration between the various AEC indus- "
                    },
                    {
                        "data": "tries, including BIM, virtual and augmented reality. "
                    },
                    {
                        "data": "Meanwhile, Phil Bernstein, the associate dean at the "
                    },
                    {
                        "data": "Yale School of Architecture, said current trends suggest "
                    },
                    {
                        "data": "big data, computational design and integrating machine "
                    },
                    {
                        "data": "learning could “eventually help architects design more "
                    },
                    {
                        "data": "optimized buildings and reduce the waste that comes "
                    },
                    {
                        "data": "when expectations don’t line up with how a building ac- "
                    },
                    {
                        "data": "tually performs in the real world,” The Architect’s News- "
                    },
                    {
                        "data": "paper reported. "
                    },
                    {
                        "data": "But BIM and virtual reality have been around for sev- "
                    },
                    {
                        "data": "eral years now, and while they have certainly influenced "
                    },
                    {
                        "data": "design and construction practices, they haven’t changed "
                    },
                    {
                        "data": "the universe, it seems. Something else needs to give – "
                    },
                    {
                        "data": "and the suggestion from some speakers is that it will "
                    },
                    {
                        "data": "come from highly capitalized new integrated industry or- "
                    },
                    {
                        "data": "ganizations, and individual owners demanding greater "
                    },
                    {
                        "data": "technological adaptation and accountability. "
                    },
                    {
                        "data": "The disruptors, such as Katerra, combine "
                    },
                    {
                        "data": "modular/factory building with a beginning-to-end design, "
                    },
                    {
                        "data": "engineering and construction collaboration process, "
                    },
                    {
                        "data": "meaning that the owner places the order, architects and "
                    },
                    {
                        "data": "engineers (often in remote locations), prepare the de- "
                    },
                    {
                        "data": "sign, and the work is scheduled in factory settings, with "
                    },
                    {
                        "data": "modular components shipped to the actual construction "
                    },
                    {
                        "data": "site for rapid assembly. "
                    },
                    {
                        "data": "If these services catch on – and billions of dollars in "
                    },
                    {
                        "data": "investment capital have been staked on the proposition "
                    },
                    {
                        "data": "– the traditional design and construction model will be "
                    },
                    {
                        "data": "upended as designers, contractors and subtrades either "
                    },
                    {
                        "data": "need to buy into the new competing mammoth building "
                    },
                    {
                        "data": "organizations, or fight for a shrinking market share "
                    },
                    {
                        "data": "where traditional practices and relationships remain in "
                    },
                    {
                        "data": "place. Another drive for change is happening at the owner- "
                    },
                    {
                        "data": "ship level. Jeremy Munn, a senior capital project man- "
                    },
                    {
                        "data": "ager for the design and construction department within "
                    },
                    {
                        "data": "the facilities division of Northeastern University in "
                    },
                    {
                        "data": "Boston, for example, described how the university is fi- "
                    },
                    {
                        "data": "nally getting all the pieces together in a digital procure- "
                    },
                    {
                        "data": "ment/building cycle, but not by using a one-size fits all "
                    },
                    {
                        "data": "system, and with plenty of training and support to en- "
                    },
                    {
                        "data": "courage compliance (and this progress is coming be- "
                    },
                    {
                        "data": "cause the owner is driving the agenda, not the "
                    },
                    {
                        "data": "architects, engineers or contractors.) "
                    },
                    {
                        "data": "Munn said his department manages 250 new pro- "
                    },
                    {
                        "data": "jects a year, of varying size and complexity, from minor "
                    },
                    {
                        "data": "retrofits to multi-million dollar new structures. "
                    },

                    },

                        "data": "There are different software packages that do some, "
                    },
                    {
                        "data": "but not all, of the tasks the university is seeking – but the "
                    },
                    {
                        "data": "solution is not to force everything into a single piece of "
                    },
                    {
                        "data": "software, but rather to integrate the different tools and "
                    },
                    {
                        "data": "software resources appropriate to the different stages in "
                    },
                    {
                        "data": "the design, construction and operation cycle. "
                    },

                        "data": "He said the university had 206 active users in its e- "
                    },

                        "data": "management system in 2016; by 2018, the active users "
                    },

                        "data": "had increased to 660. “Most are consultants,” he said. "

                        "data": "As more capital projects have been managed by the sys- "
                    },

                        "data": "tem, he said the number of automated processes in- "
                    },

                        "data": "creased from nine in 2016 to 27 in 2018. There’ll be "
                    },

                    },

                        "data": "and operations, moving from a manual to automated de- "
                    },

                        "data": "ferred maintenance program, better BIM integrations, "
                    },

                        "data": "“Our value proposition is not to build faster and "
                    },

                        "data": "quicker,” he said. “It is to get students into classroom "
                    },

                        "data": "seats and researchers into labs so they can spend their "
                    },

                        "data": "NIH (National Institute of Health) grants.” "
                    },

                        "data": "Meanwhile architect Jan Leenknegt of BIG hinted at "
                    },

                    },

                        "data": "new million plus sq. ft. office complex in Sunnyvale is "
                    },

                        "data": "challenging traditional design practices with new techno- "
                    },

                    },

                        "data": "However, speaking generally, he explained how collab- "
                    },

                        "data": "oration is pushing “interoperability across contractural "
                    },
                    {
                        "data": "boundaries” as the number of design tools is declining "
                    },
                    {
                        "data": "through consolidation, and documentation is becoming "
                    },
                    {
                        "data": "increasingly automated. He also said BIM is becoming "
                    },
                    {
                        "data": "increasingly important, and is vital for complex architec- "
                    },
                    {
                        "data": "tural designs. "
                    },
                    {
                        "data": "However, technology doesn’t replace the human ele- "
                    },
                    {
                        "data": "ment. Owners, designers and contractors need to “bring "
                    },
                    {
                        "data": "(software) tools to the teams and empower intelligent "
                    },
                    {
                        "data": "humans,” he said. “The tools are not the same for every "
                    },
                    {
                        "data": "project.” There needs to be training, standards and tem- "
                    },
                    {
                        "data": "plates, annual BIM model audits, and feedback. "
                    },
                    {
                        "data": "Can we draw any take-action conclusions from these "
                    },
                    {
                        "data": "observations? The answer, I think, is we need to be "
                    },
                    {
                        "data": "aware of the technology adaptation drivers/disruptors – "
                    },
                    {
                        "data": "namely forward-thinking owners and disruptive technol- "
                    },
                    {
                        "data": "ogy service/building companies, and develop our own "
                    },
                    {
                        "data": "awareness on how to integrate and implement the new "
                    },
                    {
                        "data": "tools in a more collaborative environment. Otherwise, we "
                    },
                    {
                        "data": "might be caught in the newspaper industry trap, through "
                    },
                    {
                        "data": "which only a few nimble, creative and technologically as- "
                    },
                    {
                        "data": "tute businesses are surviving. "
                    },

                    },

                        "data": "nesses in the Canadian construction industry, repre- "
                    },
                    {
                        "data": "sented in part by the Canadian Construction Association "
                    },
                    {
                        "data": "(CCA), which asserted that the state ownership of the "
                    },
                    {
                        "data": "business would create unfair advantages to the foreign "
                    },
                    {
                        "data": "business. The decision against the takeover by China Communi- "
                    },

                        "data": "cations Construction Co. Ltd. follows a national security "
                    },
                    {

                        "data": "put in a restriction that prevents a company that simply "

                        "data": "provisions respecting government procurement. "

                        "data": "The Canadian construction industry is highly complex, "
                    },
                    {
                        "data": "using sophisticated, technology-forward and innovative "
                    },
                    {
                        "data": "techniques. From drones to IoT on bridges to 3D mod- "
                    },

                        "data": "elling, Canadian know-how is exceptional, and CCA wel- "
                    },
                    {
                        "data": "comes the government’s commitment to encouraging "
                    },

                        "data": "entrepreneurialism. The Government of Canada is engaging in a massive "

                    },

                        "data": "contractors and design professionals fulfill their legal "
                    },

                        "data": "obligations and protect their interests. However, the "
                    },
                    {
                        "data": "biggest changes are another 18 months away, when sig- "
                    },
                    {
                        "data": "nificant prompt payment and new adjudication rules go "
                    },
                    {
                        "data": "into effect. "
                    },
                    {
                        "data": "The Ontario legislation is significant elsewhere in the "
                    },
                    {
                        "data": "country because the federal government and several "
                    },
                    {
                        "data": "other provinces are preparing new construction laws in- "
                    },
                    {
                        "data": "corporating many of the provisions of the new Ontario "
                    },
                    {
                        "data": "legislation. Several lawyers and consultants outlined the changes "
                    },
                    {
                        "data": "– including challenging transitional provisions – at a May "
                    },
                    {
                        "data": "14 seminar sponsored by the Construction and Design "
                    },
                    {
                        "data": "Alliance of Ontario (CDAO). "
                    },
                    {
                        "data": "Geza Banfai with McMillan LLP outlined the reasons "
                    },
                    {
                        "data": "for the new rules, which trace their roots to lobbying sev- "
                    },

                        "data": "eral years ago from the National Trade Contractors Coali- "
                    },
                    {
                        "data": "tion of Canada (NTCCC), which led to a private member’s "
                    },
                    {
                        "data": "bill that failed to move forward after government min- "
                    },
                    {
                        "data": "istries and agencies, private owners, general contractors, "
                    },
                    {
                        "data": "consultants and lenders raised strong objections. "
                    },
                    {
                        "data": "However, the provincial government agreed to com- "
                    },

                        "data": "mission lawyers Bruce Reynolds and Sharon Vogel to "
                    },

                        "data": "conduct an extensive review of old Construction Lien Act, "
                    },

                        "data": "dating back from the 1980s. After extensive consultation "

                    },

                        "data": "The so-called “modernization” changes include: "
                    },
                    {
                        "data": "• An extension of the lien “preservation period”, from 45 "
                    },
                    {
                        "data": "to 60 days and a longer lien “perfection period” from "
                    },
                    {
                        "data": "45 to 90 days after the last day the lien could have "
                    },
                    {
                        "data": "been preserved; both of these ensure there “is more "
                    },
                    {
                        "data": "time to negotiate and work out disputes rather than "
                    },
                    {
                        "data": "come to the lawyers;” and "
                    },
                    {
                        "data": "• Mandatory holdback release by the end of the hold- "
                    },
                    {
                        "data": "back period, unless owners publish their intentions "
                    },
                    {
                        "data": "not to release the holdback in a public notice no later "
                    },
                    {
                        "data": "than 40 days after the publication of the Certificate of "
                    },
                    {
                        "data": "Substantial Performance. "
                    },

                        "data": "“There’s a large deliberate gap,” Betts said. “An "
                    },
                    {
                        "data": "owner has to put their cards on the table” so that con- "
                    },
                    {
                        "data": "tractors and subtrades know where they are ahead of the "
                    },
                    {
                        "data": "lien filing deadline. Effectively, the new rules give the "
                    },
                    {
                        "data": "contractors and owners “an extra 20 days to settle dis- "
                    },
                    {
                        "data": "putes and avoid standoffs.” "
                    },
                    {
                        "data": "The new legislation also allows for owners and con- "
                    },
                    {
                        "data": "tractors to release holdback on larger projects ($10 mil- "
                    },
                    {
                        "data": "lion or more) before the project is completed. "
                    },
                    {
                        "data": "“The theme throughout all of the changes, in these "
                    },
                    {
                        "data": "subtle changes, is getting cash flowing through the pro- "
                    },
                    {
                        "data": "ject faster from the owners through the contractors to "
                    },
                    {
                        "data": "suppliers and subcontractors, and avoiding disputes. "
                    },
                    {
                        "data": "There are other changes, as well: "
                    },
                    {
                        "data": "• Multiple improvements can be treated as separate "
                    },
                    {
                        "data": "contracts for the purposes of determining the sub- "
                    },
                    {
                        "data": "stantial performance date and lien periods; so con- "
                    },
                    {
                        "data": "tractors don’t have to wait for every bundled part of "
                    },
                    {
                        "data": "the overall project to be completed before receiving "
                    },
                    {
                        "data": "their holdbacks. However, this provision applies at the "
                    },
                    {
                        "data": "owner/general contractor level, and Betts said “It’s not "
                    },
                    {
                        "data": "clear how this will play out on subcontractors and sup- "
                    },
                    {
                        "data": "pliers.” "

                    },

                        "data": "sition periods.” "
                    },

                        "data": "The regulations and legislation suggest that if any "
                    },
                    {
                        "data": "contract is in force or “if there is any activity such as a "
                    },
                    {
                        "data": "pre-qualification happening before July 1,” the old rules "
                    },
                    {
                        "data": "apply. Someone in the audience asked what the status "
                    },
                    {
                        "data": "would be if you were on a general pre-qualification list "
                    },
                    {
                        "data": "rather than one for a specific project. Panelists re- "
                    },
                    {
                        "data": "sponded by saying they aren’t sure – this may be one "
                    },
                    {
                        "data": "issue that would need to be resolved through a judicial "
                    },
                    {
                        "data": "process, but Raboud had a simple answer: “Assume (the "
                    },
                    {
                        "data": "lien period) is 45 days and not 60 days” -- in other words, "
                    },
                    {
                        "data": "behave as if the old law applies, unless you are certain "
                    },
                    {
                        "data": "the new rules will be valid. "
                    },
                    {
                        "data": "WeirFoulds LLP partner Glenn Ackerley said the “sub- "
                    },
                    {
                        "data": "stantial performance” criteria has changed – monetary "
                    },
                    {
                        "data": "limits have been doubled. Now, substantial performance "
                    },
                    {
                        "data": "occurs when the value of the project outstanding meets "
                    },
                    {
                        "data": "the test of three percent of the first $1 million of the pro- "
                    },
                    {
                        "data": "ject’s value (instead of $500,000); two per cent of the "
                    },
                    {
                        "data": "second $1 million (again, instead of $500,000) and one "
                    },
                    {
                        "data": "per cent of the remaining value. "
                    },
                    {
                        "data": "Jerry Paglia, director of procurement for the Regional "
                    },
                    {
                        "data": "Municipality of York, says there is a “lot of training "
                    },
                    {
                        "data": "needed for owners and consultants.” "
                    },
                    {
                        "data": "“The phasing in of requirements (including the future "
                    },
                    {
                        "data": "prompt payment and adjudication provisions) is going to "
                    },
                    {
                        "data": "create complexity,” he said. “With two phase in periods, "
                    },
                    {
                        "data": "there could be three different forms of contract at the "
                    },
                    {
                        "data": "same time.” "
                    },
                    {
                        "data": "“Owners, staff and consultants are going to have to "
                    },
                    {
                        "data": "know which contract applies to the project, with longer "
                    },
                    {
                        "data": "period for lien rights and less flexibility in what we can "
                    },
                    {
                        "data": "deduct from the payments.” "
                    },
                    {
                        "data": "“We can’t deduct funds from other projects. The ad- "
                    },
                    {
                        "data": "ministration for the contracts will take longer.” "
                    },
                    {
                        "data": "“There’s going to be more scrutiny on dealing with "
                    },
                    {
                        "data": "general contractors, terminating and not paying – we’ll "
                    },
                    {
                        "data": "have to publish it. (There’ll be) more of a public relation- "
                    },
                    {
                        "data": "ship, as that information trickles down to subcontrac- "
                    },
                    {
                        "data": "tors.” Eric Hoffstein of Minden Gross LLP said there will be "
                    },
                    {
                        "data": "new bookkeeping challenges, especially for smaller busi- "
                    },
                    {
                        "data": "nesses, because of the much more stringent trust ac- "
                    },
                    {
                        "data": "count requirements. “If you don’t have an outside "
                    },
                    {
                        "data": "bookkeeper helping with the accounting, now might be a "
                    },
                    {
                        "data": "good time to do that.” "
                    },
                    {
                        "data": "Meanwhile, Steve Ness, president of the Surety Asso- "
                    },
                    {
                        "data": "ciation of Canada (SAC), outlined new bonding rules, in- "
                    },
                    {
                        "data": "cluding the significant requirement that all public "
                    },
                    {
                        "data": "projects greater than $500,000 must have 50 per cent "
                    },
                    {
                        "data": "performance and payment bonds. “Public” includes the "
                    },
                    {
                        "data": "broader public sector such as school districts. "
                    },
                    {
                        "data": "Other changes are intended to bring much greater "
                    },
                    {
                        "data": "clarity and responsiveness to the bond claims process, "
                    },
                    {
                        "data": "with finite deadlines for responding to claims by either "
                    },
                    {
                        "data": "accepting, denying or seeking more information. "
                    },
                    {
                        "data": "The speakers indicated that, while the regulations "
                    },
                    {
                        "data": "going into effect on July 1 will impact the industry, the "
                    },
                    {
                        "data": "really big changes will occur in October 2019, when the "
                    },
                    {
                        "data": "new law’s remaining provisions will be implemented. "
                    },
                    {
                        "data": "These include mandatory prompt payment require- "
                    },
                    {
                        "data": "ments. In about a year and a half, “owners must pay "
                    },
                    {
                        "data": "within 28 days of receipt of proper invoices,” said Chris "
                    },
                    {
                        "data": "Stanek, a partner at Gowling WLG. There are specific re- "
                    },
                    {
                        "data": "quirements in defining a “proper invoice”. "
                    },
                    {
                        "data": "Owners can dispute the invoice “but must provide "
                    },
                    {
                        "data": "written notice in the prescribed form” within 14 days of "
                    },
                    {
                        "data": "receiving the invoice. The notice/response system is de- "
                    },
                    {
                        "data": "signed to tie in with a new adjudication system, which al- "
                    },
                    {
                        "data": "lows an exceptionally rapid decision on payments by a "
                    },
                    {
                        "data": "third-party expert adjudicator (agreed to by the parties or "
                    },
                    {
                        "data": "selected from a qualified panel) to determine if the pay- "
                    },
                    {
                        "data": "ment would actually be due. "
                    },
                    {
                        "data": "“If the owner has not paid but delivered a notice of "
                    },
                    {
                        "data": "non-payment, the contractor must give notice of dispute "
                    },
                    {
                        "data": "within seven days after receipt of the owner’s notice of "
                    },
                    {
                        "data": "non-payment,” Stanek said. "
                    },
                    {
                        "data": "Betts added that there is an additional concern for "
                    },
                    {
                        "data": "contractors. “If a notice of non-payment has also not "
                    },
                    {
                        "data": "been delivered, the contractor will have 35 days to de- "
                    },
                    {
                        "data": "cide to either pay its subcontractor out of its own pocket, "
                    },
                    {
                        "data": "or to commence a fight with the owner through adjudica- "
                    },
                    {
                        "data": "tion.” Everyone in the construction supply chain will subject "
                    },
                    {
                        "data": "the notice/prompt payment provisions and if you don’t "
                    },
                    {
                        "data": "pay, “you will need to pay statutory interest.” If pay- "
                    },
                    {
                        "data": "ments aren’t made after an adjudicator renders a deter- "
                    },
                    {
                        "data": "mination, contractors and suppliers can leave the job site "
                    },
                    {
                        "data": "and charge remobilization fees if they return. "
                    },
                    {
                        "data": "Banfai said the prompt payment and adjudication pro- "
                    },
                    {
                        "data": "visions, when they are implemented, are “collectively "
                    },
                    {
                        "data": "nothing short of a cultural change in the industry.” "
                    },
                    {
                        "data": "One audience member asked what the rules will be "
                    },
                    {
                        "data": "for federal contracts. Betts responded that Reynolds and "
                    },
                    {
                        "data": "Vogel are currently conducting a review for the federal "
                    },
                    {
                        "data": "government, which is expected – along with several "
                    },
                    {
                        "data": "other provinces – to pass similar prompt payment legisla- "
                    },
                    {
                        "data": "tion soon. These changes will bring Ontario and Canada "
                    },

                        "data": "to the state of practice in Britain, Europe, Australia, and "
                    },

                    },

                        "data": "ing how things worked, Tiffany Whitnack set her sights "
                    },

                        "data": "on architectural technology, gained some experience in "
                    },
                    {
                        "data": "the field and then pursued her designation. She "
                    },
                    {
                        "data": "is now an architect with NORR. "
                    },
                    {
                        "data": "Whitnack came to NORR during her intern- "
                    },
                    {
                        "data": "ship through the University of Calgary’s Master "
                    },
                    {
                        "data": "of Architecture program and after graduation, "
                    },
                    {
                        "data": "was hired as an architectural designer. Over time "
                    },
                    {
                        "data": "she progressively took on more responsibilities "
                    },
                    {
                        "data": "and management duties and, she says, plans to "
                    },
                    {
                        "data": "continuer her advancement with the company. "
                    },
                    {
                        "data": "As an architectural designer in NORR’s Public "
                    },
                    {
                        "data": "Works studio, Whitnack tends to work on large "
                    },
                    {
                        "data": "and complex projects. Her responsibilities often "
                    },
                    {
                        "data": "include project design and co-ordination of the "
                    },
                    {
                        "data": "design and consultation teams, both internal and external "
                    },
                    {
                        "data": "to the office. "
                    },
                    {
                        "data": "“I work closely with the client and often their chosen "
                    },
                    {
                        "data": "construction management team. Once the project pro- "
                    },
                    {
                        "data": "gresses to construction drawings I work with our team "
                    },
                    {
                        "data": "lead and technologist team to ensure that the project vi- "
                    },
                    {
                        "data": "sion and intent are carried through to the completion of "
                    },
                    {
                        "data": "the project.” "
                    },
                    {
                        "data": "As a female in a male dominated industry, Whitnack "
                    },
                    {
                        "data": "says her natural introversion can mean she is overshad- "
                    },
                    {
                        "data": "owed in a group of people and sometimes she finds she "
                    },
                    {
                        "data": "must work twice as hard to have her credibility recog- "
                    },
                    {
                        "data": "nized when meeting with new clients or consultants. “I "
                    },
                    {
                        "data": "look younger than I am as well so often struggle to be "
                    },
                    {
                        "data": "recognized as the authority in a room of men. I feel that I "
                    },
                    {
                        "data": "need to fight harder be recognized as the leader.” "
                    },
                    {
                        "data": "Part of that struggle may be what she describes as her "
                    },
                    {
                        "data": "greatest challenge in her career – her own expectations "
                    },
                    {
                        "data": "and the need she feels to constantly improve and push "
                    },
                    {

                    },

                        "data": "chitect. “It was a dream that I worked hard to achieve. I "
                    },

                        "data": "did not always have the support of those around me, but I "
                    },

                        "data": "proved that with determination and hard work that my "
                    },
                    {
                        "data": "dream was achievable. I also see this as a success in the "
                    },
                    {
                        "data": "fact that so few women with a Master "
                    },
                    {
                        "data": "of Architecture follow through on the "
                    },
                    {
                        "data": "process to become registered.” "
                    },
                    {
                        "data": "Despite the challenges she has ex- "
                    },
                    {
                        "data": "perienced, Whitnack says she could "
                    },
                    {
                        "data": "not think of a more rewarding profes- "
                    },
                    {
                        "data": "sion. “Every day we make a difference "
                    },
                    {
                        "data": "in peoples’ lives. Though the impact "
                    },
                    {
                        "data": "can vary - we create labs for those "
                    },
                    {
                        "data": "finding the cure for diseases, we cre- "
                    },
                    {
                        "data": "ate affordable homes for those that "
                    },
                    {
                        "data": "need a helping hand, we create "
                    },
                    {
                        "data": "spaces for people to age in place – we "
                    },
                    {
                        "data": "are always touching the lives around us.” "
                    },
                    {
                        "data": "She says for that reason alone, she would encourage "
                    },
                    {
                        "data": "more women to consider becoming architects. “Every "
                    },
                    {
                        "data": "day presents you with a new challenge and provides new "
                    },
                    {
                        "data": "opportunities to grow as a person and change the life of "
                    },
                    {
                        "data": "someone else, even in a small way.” "
                    },
                    {
                        "data": "Whitnack also believes that women bring a different "
                    },
                    {
                        "data": "type of management skill to the top down leadership "
                    },
                    {
                        "data": "styles of men; a leadership style that is more collabora- "
                    },
                    {
                        "data": "tive and that welcomes others’ point of views with infor- "
                    },
                    {
                        "data": "mation sharing. "
                    },
                    {
                        "data": "Sharing concern for team members and seeking help "
                    },
                    {
                        "data": "from others would have been seen as signs of weakness "
                    },
                    {
                        "data": "or inability in the past. However, this approach fits well "
                    },
                    {
                        "data": "with the current collaborative design philosophies for "
                    },
                    {
                        "data": "construction. “By having more women on the design "
                    },
                    {
                        "data": "teams and in management roles we can find new and "
                    },
                    {
                        "data": "better ways to communicate and collaborate.” "
                    },
                    {
                        "data": "Her advice to women: “I love the adage ‘What does "
                    },
                    {
                        "data": "not kill you only makes you stronger.’ There is no point in "
                    },
                    {
                        "data": "complaining about something that does not go your way. "
                    },
                    {
                        "data": "Pick yourself up and find a way to make something even "
                    },
                    {
                        "data": "better from the experience. There is always something "
                    },
                    {
                        "data": "new to learn.” "
                    },
                    {
                        "data": "When she is not pursuing her career goals, Whitnack is "
                    },
                    {
                        "data": "a member of the Kinette Club of Calgary, an all Canadian "
                    },
                    {
                        "data": "service organization made up of outstanding community "
                    },
                    {
                        "data": "volunteers. “Along with this group of wonderful women "
                    },
                    {
                        "data": "we are enhancing quality of life in our community by pro- "
                    },

                    },

                    },

                        "data": "volved in all kinds of sport, Lori Haywood-Farmer’s path "
                    },

                        "data": "has included a degree in biology and an apprenticeship in "
                    },
                    {
                        "data": "carpentry. She is now a key member of the team at Kam- "
                    },
                    {
                        "data": "loops, BC-based custom homebuilder, Timeless Develop- "
                    },
                    {
                        "data": "ments. Haywood-Farmer says she originally went to work for "
                    },
                    {
                        "data": "Timeless Developments when the owner, a friend of her "
                    },
                    {
                        "data": "brother, needed labour help. That was in 2003. She has "
                    },
                    {
                        "data": "since acquired her carpentry papers and is now involved "
                    },
                    {
                        "data": "with many different aspects of the custom homebuilding "
                    },
                    {
                        "data": "process. When she was studying carpentry, she says there "
                    },
                    {
                        "data": "were no other women in her program. In the workforce "
                    },
                    {
                        "data": "though, and working for Timeless Developments, she "
                    },
                    {
                        "data": "says she has worked with a few and that really, anyone "
                    },
                    {
                        "data": "who is interested in and willing to work is welcome. "
                    },
                    {
                        "data": "She says there is a certain satisfaction that comes "
                    },
                    {
                        "data": "from taking a home from concept to final product. “When "
                    },
                    {
                        "data": "you work with a client to understand what they want, get "
                    },
                    {
                        "data": "the drawings, and then help create their dream, that is "
                    },
                    {
                        "data": "something special.” "
                    },
                    {
                        "data": "Her favourite role, she says, is the finishing work that "
                    },
                    {
                        "data": "must be done to complete each project. Whether it is the "
                    },
                    {
                        "data": "interior details, the custom furniture or accessory pieces "
                    },
                    {
                        "data": "she crafts to complete the home’s aesthetic, this she "
                    },
                    {
                        "data": "says, provides balance and allows her to be flexible and "
                    },
                    {
                        "data": "creative. “There is a lot of interest in barnwood these days,” she "
                    },

                        "data": "says. “For me, growing up on the farm, that feels full cir- "
                    },

                        "data": "cle. I love being able to work with something that is so fa- "
                    },

                        "data": "miliar and natural to me, and to turn it into something "
                    },

                    },
